Terms of Use

The agreement governing your access to and use of campx.in and its sub-domains, published in compliance with the Information Technology Act, 2000 and the Intermediary Rules, 2021.

1.Introduction and Acceptance

CampX Edutech Private Limited (“CampX”, “we”, “us”, or “our”) provides this website at campx.in, together with its sub-domains, blogs, landing pages, marketing micro-sites, product pages, downloadable resources, demo-booking forms, event registration pages, and the careers portal (collectively, the “Website”). These Terms of Use (“Terms”) govern your access to and use of the Website.

By accessing, browsing, or otherwise using the Website, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, please do not access or use the Website.

These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signature.

2.Scope and Applicability

These Terms apply solely to your use of the Website. They do not, by themselves, govern:

  • Use of the CampX Platform: access to and use of the cloud-hosted CampX software-as-a-service platform by an educational institution and its constituents is governed by the master subscription agreement, order form, and data-processing addendum executed between CampX and the institution.
  • Use of CampX mobile applications: access to and use of the CampX Student app, CampX Faculty app, and other CampX-branded mobile applications is governed by the in-app end-user terms presented at first launch and by the institution-level subscription agreement.
  • Third-party services: any product, service, or website operated by a third party, including those linked from the Website, is governed by the terms of that third party.

Where the Website provides a gateway through which you sign in to the Platform or a mobile application, the applicable end-user or institutional terms govern your activity within those products.

3.About CampX

CampX Edutech Private Limited is a company incorporated under the Companies Act, 2013, having its registered office at 03, Level 3, The District, My Scape Road, Nanakramguda, Financial District, Hyderabad, Telangana 500032, India. CampX builds and operates a campus-management platform used by higher-education institutions across India and select international markets.

4.Definitions

In addition to terms defined elsewhere in these Terms:

  • “Applicable Law” means all statutes, enactments, rules, regulations, notifications, guidelines, directions, and orders of any governmental, statutory, or regulatory authority that apply to the Website or to your use of the Website.
  • “Content” means all text, images, graphics, video, audio, code, documents, datasheets, white papers, case studies, blog posts, product descriptions, trademarks, logos, and other materials made available on or through the Website.
  • “User”or “you” means any individual who accesses the Website, whether or not such individual creates an account or submits a form.
  • “User Submission” means any information, material, file, or communication you submit through the Website, including through demo requests, contact forms, downloadable-resource gates, event registrations, newsletter sign-ups, support enquiries, the careers portal, and any chat or feedback widgets.

5.Eligibility

You may use the Website only if you are at least eighteen (18) years of age and are competent to enter into a binding contract under the Indian Contract Act, 1872. By using the Website, you represent and warrant that you meet these eligibility requirements. If you are accessing the Website on behalf of an organisation, you further represent and warrant that you are duly authorised to bind that organisation to these Terms.

The Website is intended for a general professional audience and is not directed at children. We do not knowingly solicit or collect Personal Data from children through the Website; the manner in which children’s data on the Platform is handled is described in the Privacy Policy.

6.Permitted Use of the Website

Subject to your continued compliance with these Terms, CampX grants you a limited, non-exclusive, non-transferable, non-sub-licensable, revocable right to access and view the Website for lawful, personal, internal business, or evaluation purposes only.

You may, in particular:

  • browse, read, and bookmark publicly available pages of the Website;
  • download, print, or share publicly designated materials such as brochures, white papers, and case studies, in unmodified form, for your own internal evaluation or reference, with all copyright and proprietary notices preserved;
  • submit demo requests, sales enquiries, support enquiries, and job applications through the designated forms; and
  • subscribe to newsletters, blogs, and event invitations using a valid email address you are authorised to use.

All rights not expressly granted in these Terms are reserved by CampX and its licensors.

7.Account Registration on the Website

Certain features of the Website may require you to create a basic account or provide identifying information (for example, to access gated resources, register for a webinar, or apply through the careers portal). When you register, you agree to:

  • provide accurate, current, and complete information;
  • maintain and promptly update such information;
  • keep any password or access credential confidential and not share it with any third party; and
  • notify us promptly at srikanth@campx.in of any unauthorised access to or use of your Website account.

You are responsible for all activities that occur under your account. CampX is not liable for any loss or damage arising from your failure to comply with the obligations set out in this section.

8.Prohibited Use

You agree not to use the Website, and not to permit any other person to use the Website on your behalf, in any manner that:

  • violates Applicable Law, including the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (the “Intermediary Rules”);
  • infringes any patent, trademark, copyright, trade-secret, or other intellectual-property or proprietary right of CampX or any third party;
  • is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
  • harms minors in any way;
  • deceives or misleads the addressee about the origin of any message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
  • impersonates another person, entity, or institution, or misrepresents your affiliation with any person, entity, or institution;
  • threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting other nations;
  • contains software viruses, worms, trojans, ransomware, time bombs, or any other computer code, files, or programs designed to interrupt, destroy, limit the functionality of, or surreptitiously intercept any system, data, or Personal Data;
  • attempts to probe, scan, penetration-test, reverse-engineer, decompile, disassemble, or otherwise circumvent any security feature or access control of the Website;
  • uses any robot, spider, scraper, crawler, data-mining tool, or any similar automated means to access, extract, copy, or index any part of the Website except as expressly permitted by our robots.txt or by prior written consent of CampX;
  • overloads, floods, or otherwise interferes with the proper working of the Website, the underlying infrastructure, or other users' use of the Website;
  • frames, mirrors, or republishes the Website or any substantial portion of its Content without our prior written consent;
  • uses the Website to send unsolicited commercial communications, spam, or any other prohibited form of communication; or
  • uses the Content or any data collected from the Website to train machine-learning or artificial-intelligence models, or for any commercial purpose other than as expressly permitted in these Terms.

CampX reserves the right, in its sole discretion, to investigate any suspected violation and to take such action as it deems appropriate, including suspending or terminating your access to the Website and reporting the activity to law-enforcement or regulatory authorities.

9.Intellectual Property Rights

9.1 Ownership of Content

The Website and all Content made available on it, including the design, layout, look-and-feel, structure, source code, object code, software, product documentation, screenshots, graphics, illustrations, photographs, audio, video, and text, are owned by or licensed to CampX and are protected by copyright, trademark, design, database, and other intellectual-property laws of India and other jurisdictions. All rights, title, and interest in and to the Website and the Content (other than User Submissions) vest exclusively in CampX or its licensors.

9.2 Trademarks

“CampX”, the CampX logo, the names of CampX products and modules, and all related taglines, marks, and trade dress are trademarks of CampX, whether registered or unregistered. You may not use any CampX trademark without our prior written consent, and you may not use any CampX trademark in a manner that is likely to cause confusion, disparage CampX, or dilute the value of the trademark. All other trademarks, service marks, trade names, and logos appearing on the Website are the property of their respective owners.

9.3 Feedback

If you provide CampX with any suggestions, ideas, enhancement requests, reviews, recommendations, or other feedback in relation to the Website, the Platform, or our products (“Feedback”), you grant CampX a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sub-licensable, and transferable licence to use, reproduce, modify, create derivative works of, and otherwise commercially exploit such Feedback for any purpose, without any obligation of attribution or compensation to you. Feedback is provided on a non-confidential basis.

10.User Submissions

You retain such ownership rights as you may have in any User Submission. However, by making a User Submission, you grant CampX a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable licence to host, store, reproduce, transmit, display, adapt, and otherwise use the User Submission to the extent necessary to operate the Website, respond to your request, deliver the resource you requested, communicate with you, comply with Applicable Law, and improve our Services.

You represent and warrant in respect of every User Submission that:

  • you have all rights, consents, and authorisations necessary to make the User Submission and to grant the licence above;
  • the User Submission is accurate, complete, and not misleading;
  • the User Submission does not contain any Personal Data of any third party in respect of which you have not obtained a valid legal basis for sharing it with CampX; and
  • the User Submission does not violate any provision of Section 8 (Prohibited Use) of these Terms.

CampX has no obligation to monitor User Submissions but reserves the right to review, refuse, edit, or remove any User Submission, in whole or in part, at any time and for any reason, without notice.

11.Third-Party Links, Content, and Services

The Website may contain links to, or embed content or services from, third-party websites, applications, or platforms (including social-media channels, video-hosting services, payment gateways, calendar-booking tools, analytics providers, and customer-engagement widgets). Such links and embeds are provided for your convenience and do not imply any endorsement or affiliation by CampX.

CampX has no control over, and assumes no responsibility for, the content, privacy practices, or terms of any third-party website, application, or service. Your use of any such third-party offering is at your own risk and is governed by the terms of the relevant third party.

12.Demo Requests, Sales Enquiries, and Marketing Communications

When you submit a demo request, sales enquiry, or contact form, or when you subscribe to a newsletter or register for an event, you consent to be contacted by CampX at the email address, phone number, or other channel you have provided, for the purpose of responding to your enquiry, scheduling a demo, providing related product information, and sending communications about our products, events, and offerings.

You may unsubscribe from marketing communications at any time by clicking the unsubscribe link included in such communications, by adjusting your preferences in any account you have on the Website, or by writing to srikanth@campx.in. Withdrawal of consent will not affect transactional or service-related communications that we are required or permitted to send in connection with your enquiry, account, or relationship with CampX.

13.Cookies and Analytics

The Website uses cookies and similar technologies for authentication, session management, security, performance measurement, analytics, and, where you consent, marketing. The categories of cookies used, the basis on which we deploy them, and the controls available to you are described in our Privacy Policy. Where required by law, we present a cookie banner that allows you to accept, reject, or manage non-essential cookies; you may also control cookies through your browser settings.

14.Privacy and Personal Data

Our collection and processing of Personal Data through the Website is governed by the CampX Privacy Policy, available at campx.in/privacy (the “Privacy Policy”). By using the Website, you acknowledge that you have read and understood the Privacy Policy. The Privacy Policy is incorporated into and forms an integral part of these Terms.

15.Disclaimer of Warranties

THE WEBSITE AND THE CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT REPRESENTATIONS, WARRANTIES, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, CAMPX DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

CampX does not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that defects will be corrected. Any material downloaded from the Website is downloaded at your own discretion and risk, and you are solely responsible for any damage to your device or loss of data that results from such download.

Information published on the Website (including blog posts, white papers, product descriptions, regulatory references, pricing indicators, and roadmap statements) is provided for general informational purposes only, is not legal, regulatory, financial, or professional advice, and is subject to change without notice. You should obtain independent advice before acting on any such information.

16.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAMPX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE OR ANY CONTENT, EVEN IF CAMPX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, THE AGGREGATE LIABILITY OF CAMPX AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND LICENSORS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITE SHALL NOT EXCEED ONE THOUSAND INDIAN RUPEES (INR 1,000) IN THE AGGREGATE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under Applicable Law, including liability arising from gross negligence, wilful misconduct, or fraud.

17.Indemnification

You agree to defend, indemnify, and hold harmless CampX, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, demands, suits, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your access to or use of the Website; (ii) any User Submission you make; (iii) your breach of these Terms; or (iv) your violation of any Applicable Law or any rights of any third party.

18.Intermediary Status and Grievance Mechanism

CampX is an “intermediary” within the meaning assigned to that term under the Information Technology Act, 2000 and the Intermediary Rules in respect of User Submissions made through the Website. CampX does not initiate the transmission, select the receiver of the transmission, or select or modify the information contained in any User Submission, save as required for the operation of the Website.

In accordance with Rule 3(1)(b) of the Intermediary Rules, CampX has published these Terms and the Privacy Policy on the Website and informs Users of the categories of Content that they may not host, display, upload, modify, publish, transmit, store, update, or share. CampX may, on receipt of a court order, a notification by a competent governmental agency, or actual knowledge that any Content is unlawful within the meaning of Rule 3(1)(d), remove or disable access to such Content within the timelines prescribed under the Intermediary Rules.

In accordance with Rule 3(2) of the Intermediary Rules, CampX has designated a Grievance Officer to receive and address complaints in relation to the Website. The Grievance Officer’s contact details are provided in Section 25 below. The Grievance Officer will acknowledge every grievance within forty-eight (48) hours and endeavour to resolve it within fifteen (15) days from the date of receipt.

19.Suspension and Termination

CampX may, in its sole discretion and without prior notice, suspend, restrict, or terminate your access to all or any part of the Website at any time, including where: (i) we reasonably believe that you have breached these Terms; (ii) we are required to do so by Applicable Law or by an order of a competent court or authority; (iii) continued provision of access creates a security, fraud, or operational risk; or (iv) we discontinue the Website or any portion of it.

Sections 8 (Prohibited Use), 9 (Intellectual Property Rights), 10 (User Submissions), 15 (Disclaimer of Warranties), 16 (Limitation of Liability), 17 (Indemnification), 22 (Governing Law and Jurisdiction), and 24 (General) shall survive termination or expiry of these Terms.

20.Modifications to the Website and to these Terms

CampX reserves the right, at any time and in its sole discretion, to modify, suspend, or discontinue, temporarily or permanently, the Website or any feature, functionality, or Content of the Website, with or without notice. CampX shall not be liable to you or to any third party for any such modification, suspension, or discontinuation.

CampX may amend these Terms from time to time to reflect changes to the Website, our practices, or Applicable Law. The “Last Updated” date at the top of these Terms will indicate the date of the most recent revision. For material changes, we will provide reasonable advance notice through the Website or by email where you have provided one. Your continued use of the Website after the effective date of an update constitutes your acceptance of the revised Terms.

21.Force Majeure

CampX shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond its reasonable control, including acts of God, epidemics, pandemics, government action, war, civil unrest, terrorism, cyber-attack, telecommunications or internet failure, power failure, or natural disaster.

22.Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to conflict-of-laws principles. Subject to any mandatory provisions of law, the courts at Hyderabad, Telangana shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or in connection with these Terms or your use of the Website.

23.Notices

Any notice you wish to send to CampX in relation to these Terms or your use of the Website should be addressed to the Grievance Officer at the contact details set out in Section 25 below. CampX may give notices to you by email at the address you have provided, by posting a banner or notice on the Website, or by any other reasonable means. Notices given to you shall be deemed received: (i) if by email, on the day of transmission unless an automated delivery-failure response is received; and (ii) if by website notice, on the day the notice is first posted.

24.General

24.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into these Terms by reference, constitute the entire agreement between you and CampX in relation to your use of the Website, and supersede all prior or contemporaneous understandings, communications, and proposals, whether oral or written, in relation to the same subject matter.

24.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or authority of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable, or, if not capable of being so modified, severed from these Terms; in either case, the remaining provisions shall continue in full force and effect.

24.3 Waiver

No failure or delay by CampX to exercise any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that or any other right, power, or remedy.

24.4 Assignment

You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without the prior written consent of CampX. CampX may assign or novate these Terms, in whole or in part, to any affiliate or to any successor in interest in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of its assets, on written notice to you.

24.5 Relationship of Parties

Nothing in these Terms creates any partnership, joint venture, agency, employment, or fiduciary relationship between you and CampX. Neither party has authority to bind the other or to incur any liability on behalf of the other.

24.6 Language

These Terms have been drawn up in the English language. In the event these Terms are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency.

25.Grievance Officer and How to Contact Us

In accordance with Rule 3(2) of the Intermediary Rules and Section 8(9) of the Digital Personal Data Protection Act, 2023, the contact details of our designated Grievance Officer are set out below. The Grievance Officer will acknowledge any grievance within forty-eight (48) hours and endeavour to resolve it within fifteen (15) days from the date of receipt.

If your grievance relates to the processing of your Personal Data and is not resolved by the Grievance Officer to your satisfaction, you may approach the Data Protection Board of India in accordance with the procedures notified under the Digital Personal Data Protection Act, 2023.
